E' molto burocratica. Se questa agenzia verrebbe a scoprire che l'industria hard e' poca interessata alla salute degli attori e attrici (mettiamo che in un anno ci sarebbero 80 casi di HIV, 15 decessi di AIDS, 150 casi di STD) la OSHA potrebbe controllare l'industria hard in modi impensabili (test obbligatori per HIV e STD, uso obbligatorio di condom per tutte scene di sesso, del modo in cui si disporre dello sperma in seguito a una scena di sesso, proibizioni di atti rozzi e rischiosi come anal fist, double anal, a2m, ecc, prove/documenti che l'attore e attrice sono consapevoli dei rischi nel girare una scena particolare, ecc).
Fino ad ora la OSHA non si e' implicata in modo diretto nell'industria hard. Ma ogni volta che si sentono cose come il caso di Marc Wallice, Lady Rox e compagnia, Brian Pumper, la terra trema a Los Angeles.
Queste cose le avevo detto nel mese di settembre 2009, e ora la terra trema mel cinema hard in California.

WEST HOLLYWOOD—As the entire adult world knows by now, the California Division of Occupational Safety and Health (Cal/OSHA) revealed yesterday that it had fined both LFP Video Group LLC and producer Mark Zane's Forsaken Pictures for alleged violations of the California Health Code—and so the group that had "dropped the dime" on the two companies, AIDS Healthcare Foundation (AHF), held a news conference about it this morning at 10:30 alongside the Hustler Hollywood store. And though AVN arrived about 10 minutes late at the location due to traffic, there appeared to be just two reporters covering the "event."

On hand were several familiar faces, including AHF president Michael Weinstein, Public Health Division Director Whitney Engeran-Cordova, Communications Director Ged Kenslea and attorney Brian Chase, all of whom expressed their satisfaction at the fact that the two companies had been fined—even though they grumbled at the amounts levied: $14,175 for Hustler and $12,150 for Forsaken. (The good news: they can pay by credit card if they want.)

"Something is better than nothing, but I don't know how long it takes Larry Flynt to make $14,000," Weinstein commented. "I suspect it's not very long, so we would want to see something sterner. We would like to see an order prohibiting use that shuts down Hustler productions, and of course, we want to see the city revoke the permits and we want to see the LA County Department of Health also step in and declare it a public health nuisance, but every little bit helps. It's now established that it's against the law in California to produce [adult movies] without condoms and we're looking forward to actions by the Cal/OSHA Standards Board this year on regulations specific to the industry. We will continue to lobby the city and the county to be more aggressive as well."

"The fine was for failing to have an adequate exposure prevention plan that included barrier protection for performers," Chase explained to attendees, which included adult performer Nikki Charm. "When they go in, they look for every workplace where you might be exposed to other potentially infectious material, like you heard about in the Cal/OSHA meetings. You have to have an exposure prevention plan, and in this case, their exposure prevention plan was found to be inadequate. The ramifications for the rest of the industry are, I'm pretty sure that most of the producers have an exposure prevention plan that doesn't call for protecting workers with condoms."

However, attendees at the press conference were also given a press kit consisting of reprints of Cal/OSHA's Citations and Notifications of Penalties levied on the two companies, a "News Advisory" from Kenslea, and most interestingly, a list of companies that had previously been tagged with Cal/OSHA citations and the amounts of the penalties levied.

According to that list, which was apparently prepared by AHF staffers, since 2007, nine adult companies and their subsidiaries or d/b/a's (not counting Hustler and Forsaken) have been fined by the state, generally for either an "inadequate illness and injury prevention plan" or no such plan at all, and/or "failure to have an adequate exposure control plan for bloodborne pathogen exposure" or, again, no such plan at all.

But what was particularly interesting was the amounts of the penalties levied, which vary widely. For example, in regard to the Darren James-related infections in 2004, production company Evasive Angles was fined $18,000 in 2006, while a related company, TTB Productions, was fined $25,000, though the handout questions whether the latter amount was ever paid, since it may have been covered in a settlement worked out bewtwen Evasive Angles and the state.

On the other hand, in 2007, another adult production company was fined just $5,940, although it was cited for having both an inadequate illness and injury prevention program and an inadequate exposure control plan, while yet another company was fined $10,800 in 2009 simply for failing to have an adequate exposure control plan for bloodborne pathogen exposure.

Those numbers raise important questions regarding how Cal/OSHA goes about figuring out how much it will fine companies it believes have violated its regulations, and while each case undoubtedly has its own unique characteristics, the fines levied appear to have only a slight relationship to the violations charged.

It's an issue that, hopefully, the Division of Occupational Safety and Health will clarify as the issue of healthcare in the adult movie industry continues to be discussed.

Se hai letto bene, la somma della multa in questione non fa paura a Hustler, ma OSHA insiste su multe piu' alte.
Inoltre la OSHA potrebbe aumentare le "ispezioni" per determinare se l'industria hard lavora a rispetto delle leggi.
$14,000 per Hustler non e' un gran che, ma per una piccola ditta che haproblemi a arrivare alla fine del mese e' molto. $14,000 rappresenta piu' o meno il budget di un film hard molto ordinario.

Si legge su AVN che AIM (la clinica dove la maggior parte degli attori/attrici americani in California fanno i loro test di AIDS) ha dei problemi seri da un bel pezzo, e sembra che puo darsi chiuderanno le loro porte:

AIM Draw Stations Open, Future of Organization Unclear

SHERMAN OAKS, Calif.—Rumors are swirling around Porn Valley that AIM Medical Associates has permanently shut its doors, despite the clinic’s statement that it’s only a temporary closure due to remodeling.

AVN cannot confirm the future status of the clinic, despite an AIM statement to other media that it will re-open in a full capacity at the end of the month, because we have received contradictory information from clinic officials.

One thing is clear: AIM’s office on Van Nuys Boulevard in Sherman Oaks currently is closed for new testing services; however, its satellite draw stations remain open at this time, talent can still receive their test results by email, and AIM’s office number is active for performers to receive test results and for questions.

Regardless of AIM’s operational status, the now-private company is without doubt in deep trouble and has been for quite some time. AIM has been fighting legal battles on numerous fronts that have severely hampered its operation and put the company into crippling debt.

For example, AIM is still a named defendant in a lawsuit by 2009's "Patient Zero" as that person attempts to prevent Cal/OSHA from obtaining his/her private medical records, and is also defending aginst the suit filed by former performers Desi and Elli Foxx (who are being represented pro bono by AIDS Healthcare Foundation attorney Brian Chase) for alleged violations of medical privacy laws.

AIM also has been a central figure in the hearings held by CalOSHA regarding a petition by the AIDS Healthcare Foundation (AHF) to change the California Health Code to specifically require adult moviemakers to force their performers to use "barrier protection" when acting in sex scenes. Expenses associated with that fight include the hiring of an HIV expert, Dr. Aaron Aronow, as well as an outside health expert to challenge the Los Angeles County Department of Public Health's incorrect figures regarding the outbreaks of various STDs within the industry. None of that comes cheap.

In addition to its steadily climbing legal bills, the security of the clinic’s database has come under fire recently when a rogue website posted the real names and personal information of thousands of adult performers, much of it believed to have come from a hack of the secure AIM database.

AIM issued a statement saying that it was conducting an investigation into the matter, which is still ongoing, and that "there is preliminary information indicating that criminal behavior by persons or entities may have occurred" by accessing the database improperly.

As if that was not enough, the clinic is under increasing pressure from AHF, which has made complaints about AIM's testing and medical confidentiality protocols to several state and federal government agencies.

Could all these battles finally register a killshot to AIM’s future operation? It seems increasingly likely, but the picture painted isn’t a pretty one despite AIM’s continuing to operate, albeit at a dimished capacity.

Non succederà mai finchè il porno è un business economico. Al massimo è ipotizzabile che l'industria del porno traslochi in un altro stato Usa oppure in Canada. In tempi di crisi economica credo troverebbe molte porte spalancate.

Ummm, maybe.
Ci sono +300-500 ditte porno nella regione di Los Angeles che producono porno. Con la crisi economica che esiste ora, traslocare in un altro stato e' molto problematico. Quelle che son ben piazzate lo faranno, le altre che vivono da giorno a giorno chiuderanno e spariranno, oppure manderanno qualche regista in Ungheria a girare film.
Le attrici, registi, e aziende di produzione/montaggio/duplicazioni di DVD operano tutte nella regione di Los Angeles, e se si comincia a sparparglargli un poco qui e li, aumentano i costi.
Tutto dipende cosa vogliono fare le autorita' americane in California e che tipo di opposizione legale scontreranno.
Girare in Canada non e' tanto fattibile a causa del clima (in Canada non si puo' girare all'esteriore 12 mesi all'anno).

AIM Medical Associates’ executive director Sharon Mitchell finally confirmed to AVN after much industry speculation that the clinic has closed its doors. AIM began serving the industry in 1998.

Mitchell also acknowledged that the AIM database has been taken offline making it impossible for producers to check the status of performers’ tests.

“We are officially closed over financial hardship,” Mitchell said. “We had to close.”

Mitchell declined to make a further statement.

The database operated by AIM Medical Associates P.C. has been inaccessible to industry producers and talent since sometime Monday. A blank screen is all that resolves when one tries to access AimCheck.net.

In the meantime, most performers working in the Greater Los Angeles area are now using Talent Testing Service, which also has a wholly owned subsidiary in Miami and works with a network of draw stations located around the country
