Porn director faces charges for online distribution
Director Max Hardcore's movies have been indicted as 'obscene,' making his distribution of them on the Web and via mail a federal crime
Well-known director and producer of adult films has been indicted on obscenity charges for distributing his movies online and through the mail, the U.S. Department of Justice announced Thursday.
The U.S. Attorney's Office for the Middle District of Florida, in Tampa, handed down a 10-count obscenity indictment against Paul F. Little, age 50, of Altadena, California, and MaxWorld Entertainment on May 17. The charges against Little, known as Max Hardcore, were unsealed Wednesday.
Little and the company face five counts of transporting obscene matter by use of an interactive computer service and five counts of mailing obscene matter.
Little is director, producer, and star of films featuring acts such as urination, vomiting, and "severe violence" against actresses, the DOJ said in a press release. The indictment alleges that Little, through MaxWorld Entertainment, distributed films that met the U.S. Supreme Court's definition of obscenity through the U.S. mail to an address Florida.
The defendants are also charged with transmitting through their Web site five obscene video clips that were promotional trailers of the full-length feature films available through MaxWorld Entertainment
Little turned himself in to authorities in California Wednesday. His arraignment is scheduled for July 12 at U.S. District Court for the Middle District of Florida.
The DOJ is seeking forfeiture of the films charged in the indictment, all profits from the distribution of the films, and all property used to facilitate the obscenity, including Little's residence and the Internet domain names Maxhardcore.com and Catalinaxxx.com.
The Maxhardcore site, in a warning on the front page, defends its films by saying the performers "are intended to be portrayed and understood as fully consenting adults."
"Please note that these fictional accounts do not always exhibit safe sex, or the full range of real life relationships," the Web site says.

Max Hardcore Indicted on Federal Obscenity Charges

CHATSWORTH, Calif. - The Department of Justice has indicted adult producer/director Max Hardcore on federal obscenity charges filed in Tampa, Florida. Unsealed yesterday, the ten-count indictment charges Max with "transporting obscene matter via mail and computer."
The indictment states that Hardcore "knowingly used an interactive computer service [...] in and affecting interstate commerce for the purpose of selling and distributing obscene matter," citing the transmission of five online video clips.
Hardcore is also charged with mailing DVD copies of Max Hardcore Extreme Vol. 20, Pure Max 19 Euro Edition, Fists of Fury 4 - Euro Edition, Planet Max 16 - Euro Edition to a post office box in Tampa "on or about January 18, 2006."
If convicted of the charges, Hardcore is subject to forfeiture of merchandise, profits and property associated with the "obscene" matter, including his home in Altadena, Calif. The government is also seeking forfeiture of the director's websites maxhardcore.com, pissedonpornstars,com and catalinaxxx.com.
A DOJ press release describes Max (a.k.a. Paul Little) as a "nationally-known director, producer, and star of films featuring acts such as anal penetration, urination, insertion of an entire hand into a vagina or anus, vomiting, and severe violence" toward female performers.
Hardcore is scheduled to be arraigned on the charges on July 12. The director turned himself in to California authorities yesterday.
A statement issued by Hardcore's attorney Jeffrey J. Douglas called the director "the most recent target of the Justice Dept's effort to suppress free speech."
"These are five movies depicting consensual acts between adults, exclusively for consenting adults, there is nothing criminal about these movies," said Douglas. "The newly unsealed federal indictment arising from Tampa, Florida is one of the three pending federal indictments against commercially available materials. Recently, attorney general Alberto Gonzales described obscenity prosecutions as among the Justice Department's highest priorities."
"This is an absurd allocation of federal resources," Douglas continued. "Everyone in America understands that if you don't want to watch, you don't have to. Why can't the prosecutors understand that? There is real crime occurring in America and a shortage of resources to fight it. Why waste our taxpayers' money? How is America safer because another Hollywood filmmaker has been charged with the crime of making movies?"
"They want to take away my home, my business, and my liberty for making fictional movies with consenting adults," Hardcore said. "All Americans, whether they watch adult mat or not, can rely on our vigorous defense in this case fighting for the rights of all adults to view material they choose."
"One has to wonder the Department of Justice is spending so much of their resources attacking the adult entertainment industry," said Diane Duke, executive director of the Free Speech Coalition. "We are talking about adults viewing material produced by adults utilizing adult actors. Gonzales is already under the spotlight for pushing his personal agenda. This is just more of the same."
