....Sprecano tempo e denaro facendo cause contro tizi come Kywan Fisher che acquisto da Flava Works on-line una diecina di film porno. Flava Works aveva messo un codice speciale in quei filmati e ha potuto determinare che Fischer li aveva uppati in un sito pirata. Fisher e' stato condannato qualche giorno fa (copyright infringement) per $1,500,000! Come ha fatto il giudice a stabilire un tale risarcimento ridicolo. Ogni istanza di pirateria porta una pena massima monetaria di $150,000, dunque ha calcolato 10 film per $150,000 e voila si arriva ala cifra magica e assurda di $1,500,000.

Dopo Kywan Fisher un trbunale a Miami ha condannato Anwar Ogiste di risarcire Flava Works $1,500,000 per aver postato uno dei lori film su bit torrent. Secondo la lettura dell'accusa Anwar e una manciata di altre persone (13) hanno fatto l'upload di circa 7 film su un sito torrent, che poi sono stati scaricati 6,000 volte da altre persone.

MIAMI—Adult gay ethnic studio Flava Works has been awarded another $1.5 million default judgment. The Honorable George W. Lindberg of the United States District Court for the Northern District of Illinois issued the default judgment against Anwar Ogiste for copyright infringement regarding the uploading of seven videos. These videos had been downloaded and shared over 6000 times on BitTorrent networks.

The judgment, along with two other judgments against Kywan Fisher and Cormelian Brown earlier this month, is the largest yet in a BitTorrent copyright infringement case.

Flava Works, which operates a string of gay adult websites featuring Black and Latino models, decided to sue 13 website members for allegedly posting its videos on file sharing websites and networks. The alleged infringers were identified by Flava Works’ proprietary digital fingerprinting technology.

Anwar Ogiste was originally a defendant in a case filed in 2011 against a total 13 defendants; however, the case was severed into separate ones after one of the defendants (Andrew Clavio) asked a judge to break them apart. Only five defendants remain, Frank Rossi, Lloyd Johnson, Gregory Nance, Latavius Robinson and Andrew Clavio.

“We take piracy and theft very seriously and we intend to pursue any one who illegally distributes our content,” said CEO Phillip Bleicher.

Flava Works also has filed a lawsuit against a former website customer Nathan Rowader of San Francisco, who was caught posted the company's videos on BitTorrent sites.

state assemblyman has introduced a bill that would require condom use in all adult films made across California.

Assemblyman Isadore Hall, D-Los Angeles, said he was introducing AB 332, because he said lawmakers have a responsibility to ensure the safety of all workers.

"When it comes down to it, adult film actors are employees, like any other employee for any other business in the state," Hall said Thursday morning during a press conference at the Los Angeles office of the AIDS Healthcare Foundation.

"We have an obligation to ensure that all workers, regardless of the type of work, are protected from workplace hazards and injury."

Los Angeles County voters passed a similar local law in November. Introduced and supported by the AIDS Healthcare Foundation, Measure B requires adult film studios to apply for public health permits and for the county Department of Public Health to lead inspections and enforcement efforts.

Violators could face civil fines and criminal charges, and the Department of Public Health will be able to revoke the public health permits if it finds violations or a risk to public safety.

But one of the largest adult film studios has filed a lawsuit in federal court against the county, calling Measure B unconstitutional.

Universal City-based Vivid Entertainment LLC claims that Measure B violates actors' rights to free speech and expression.

The press conference was held in Los Angeles at the Hollywood headquarters of AIDS Healthcare Foundation (AHF), which is sponsoring Hall’s legislation and which last year successfully spearheaded Ballot Measure B, the ‘County of Los Angeles Safer Sex in the Adult Film Industry Act,’—more informally known as the ‘condoms in porn’ measure, which Los Angeles County voters overwhelmingly approved—57% to 43%—in the November 2012 election.

Measure B now requires producers of adult films to obtain a public health permit from the Los Angeles County Department of Public Health and pay a permit fee sufficient for necessary enforcement and follow all health and safety laws, including condom use by performers. Hall’s measure will expand upon the workplace protections now required in Los Angeles County to protect all adult film actors throughout the state.

AIDS Healthcare Foundation President Michael Weinstein and Darren James, a former adult film actor who contracted HIV while working in the industry, joined Assemblymember Hall at the press conference.

A porn actor who works under the name Mr. Marcus and hid the fact he tested positive for syphilis pleaded no contest Tuesday to a misdemeanor charge of exposing another to a communicable disease.
Los Angeles County Superior Court Judge Catherine Ewell sentenced Jesse Spencer to 30 days in jail, 15 days of community service and three years of probation.
He was ordered to obey all laws and not alter or conceal the results of any medical test.
In addition, Spencer was arrested 12 days ago on suspicion of drunk driving and was being held on $200,000 bail.

LOS ANGELES—Mr. Marcus has pled no contest to a misdemeanor charge of exposing at least two adult actresses to a communicable disease, the Los Angeles Times reports.

Mr. Marcus was sentenced to 30 days in jail, 15 days of community service and three years probation by Los Angeles County Superior Court Judge Catherine Ewell after exposing adult performer Lylith LaVey to syphilis, along with at least one other performer.

As part of the judgment against him, Mr. Marcus will have to follow all laws and not "alter or conceal" the results of any STI test.

As he previously told AVN, Mr. Marcus had been treated for syphilis after testing positive with his personal physician and believed himself to be syphilis free after receiving a shot of penicillin and told by his doctor to refrain from sexual activity for 10 days in order to let the medicine take its course. He subsequently worked with LaVey and others despite still testing positive, altering his test result in order to do so.

According to the court filing neither LaVey or the other performer who worked with him contracted syphilis.

This is not the end of Mr. Marcus's legal troubles though, as he was arrested for DUI on May 22, and was remanded on $200,000 bail. He's been in city jail since.

"The potential spread of syphilis and other communicable diseases is a serious threat to our entire community," city attorney Carmen Trutanich said. "My office will continue to hold accountable those who place the health and welfare of others in danger in such a reckless and thoughtless manner."

il 9 Maggio 2013 e il 22 maggio 2013. Il 22 Maggio e' stato messo in stato di fermo perche non ha rispettato le condizioni del suo primo arresto, e la cauzione aumentata a $200,000. Generalmente in California una persona deve pagare almeno il 10% della cauzione (nel caso di Marcus $20,000) per ottenere una liberta provvisoria. E nel frattempo e' stato condannato per aver avuto rapport mentre era consapevole che era infettato di sifilide. E quando esce dalle carceri dovra fare I conti con Lylith LaVey (e' abbastanza ovvio e sicuro che LaVey non ottenera mai un centesimo da Marcus).
A cosa servirebbe la liberta provvisoria a Mr Marcus? Non puo lavorare, non ha soldi. LaVey lo insegue per la causa civile. Ha spese legali che avra difficolta a pagare. Meglio la galera.
